- Understand fundamental conflict theory and different conflict styles.
- Analyze the conflict resolution continuum, recognizing where mediation fits in comparison to negotiation, arbitration, and litigation.
- Grasp the history and theory of mediation, including its purpose and when it is an appropriate process.
- Develop core mediation skills and techniques, such as effective verbal and non-verbal communication.
- Practice active listening, paraphrasing, and reframing statements to enhance understanding and manage communication barriers, including those related to angry parties or cultural differences.
- Utilize questioning techniques and build rapport with participants.
- Conduct summarizing to keep the process focused.
- Understand and effectively use private sessions (caucus).
- Apply techniques for empowering parties and conducting reality testing to help them evaluate potential outcomes.
- Strategize how to address difficult issues and manage impasses.
- Learn the elements required for writing clear and comprehensive mediated agreements and recognize issues related to the unauthorized practice of law.
- Understand and adhere to the Virginia Standards of Ethics and Professional Responsibility for Certified Mediators.
- Navigate mediator certification requirements, including the mentorship component, and gain a brief overview of the Virginia Judicial System.
- Assess the appropriateness of cases for mediation, including factors like the parties’ ability and willingness to participate effectively and in good faith.
- Explain the mediation process, the mediator’s role, and discuss confidentiality with parties.
- Promote a balanced process, procedural fairness, and mutual respect among all participants.
- Learn about professional standards regarding fees and advertising.
The training utilizes a mixture of lecture, discussion, exercises, and significant time dedicated to role-play and skill practice sessions. For the 20-hour Basic Mediation training, each trainee acts as a mediator in at least two role-plays, observed and critiqued by experienced certified mediators.
